Terms of Service

Last updated 7 November 2026

These terms are an agreement between you and FITVOW for your use of the FITVOW app and this website. By creating an account or using the app, you agree to them. If you do not agree, do not use FITVOW.

1. Who can use FITVOW

You must be at least 18 years old and able to enter a binding contract. You need an iPhone with iOS 17 or later and an Apple account. One person, one account.

2. Your health comes first

FITVOW is a fitness challenge, not medical advice. Talk to a doctor before you start if you have a health condition, an injury, are pregnant, or are unsure whether exercise is safe for you. Stop straight away if you feel pain, dizziness, shortness of breath or unusual discomfort. You exercise at your own risk.

Use a safe space, clear of obstacles, with your phone placed securely. Never chase a number through pain. The app lets you take a health day or exit an evaluation if you are injured.

3. How FITVOW works

We may adjust rules, levels, minimums and features to keep the challenge fair and the app working. Changes never take away days you have already earned. If we suspend sales of a move while we fix its counter, evaluations already running continue.

4. Purchases and refunds

5. Fair play

Rankings mean something only if everyone plays fair. You agree not to:

If we reasonably believe you have broken these rules, we may remove affected results, ranks or badges, or suspend or close your account.

6. Your content and profile

You keep ownership of the username and any photo you add. You give us permission to store and display them, together with your public record, in the app and on FITVOW share surfaces so the service can work. What is public is described in our Privacy Policy.

7. Our app

FITVOW, its name, logo, design and software belong to FITVOW. We give you a personal, non-transferable licence to use the app on Apple devices you own or control, as allowed by Apple's Usage Rules. Do not copy, resell, reverse-engineer or redistribute it, except where the law allows.

8. Ending your account

You can delete your account at any time in the app (see Delete your account). Deleting ends any live evaluation, and unused evaluation credits are lost. We may suspend or close accounts that break these terms, or stop offering the service, with notice where we reasonably can.

9. Disclaimers

We work hard to count accurately and keep FITVOW running, but the app is provided "as is" and "as available". To the extent the law allows, we do not promise that it will be uninterrupted, error-free or that it will produce any fitness result.

10. Limitation of liability

To the extent the law allows, FITVOW is not liable for indirect, incidental, special or consequential damages, or for injury that results from exercising, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer under the laws where you live.

11. Apple

These terms are between you and FITVOW, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to it, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (if any); Apple has no other warranty obligation. You confirm that you are not located in a country subject to a U.S. Government embargo or listed on a U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Changes to these terms

We may update these terms. We will change the date at the top and, for significant changes, tell you in the app before they take effect. If you keep using FITVOW after that, the new terms apply.

13. Law and disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction, except where the law of the country you live in gives you consumer protections that cannot be waived. Please contact us first; most problems can be solved by email.
